1. Scope — Website Privacy vs. HIPAA ↑ Top
It is important to understand the distinction between two kinds of information:
- Website / consumer information — data we collect through our Website, forms, cookies, analytics, and advertising. This Privacy Policy governs that information.
- Protected Health Information (PHI) — individually identifiable health information created or received in the course of providing healthcare to you. PHI is governed by HIPAA and our separate Notice of Privacy Practices.
Where these overlap (for example, when a Website form collects health-related details), we apply the stronger protection.

Information you provide to us
- Identifiers such as name, address, phone number, email address, and date of birth.
- Health-related details you choose to provide through forms or inquiries. We ask that you not submit detailed medical history or sensitive PHI through general Website forms.
- Appointment, scheduling, and inquiry information.
- Communications you send us and your preferences.
- Billing and transaction details, collected and processed by our payment processors on our behalf (we do not store full card numbers).
- Employment information if you apply for a position.
Information collected automatically
When you use the Website, we and our service providers collect information through cookies, pixels, tags, SDKs, and server logs, including IP address, device and browser type, operating system, pages viewed, links clicked, referring pages, approximate location, and similar usage data.
Information from other sources
We may receive information from advertising and analytics partners, social media platforms when you interact with us, and service providers that support our operations.

4. Cookies, Analytics, and Advertising ↑ Top
We use cookies and similar technologies for site functionality, analytics, and advertising. Our partners include Google Analytics (GA4) and Google Tag Manager, Google Ads, Meta (Facebook/Instagram), and TikTok. In addition, our scheduling platform is configured to share certain booking-funnel and conversion events with Google Analytics and Meta so we can measure advertising performance and return on ad spend. These tools may set cookies and collect usage data.
You can manage cookies through your browser settings and opt out of certain analytics (for example, via the Google Analytics Opt-out Browser Add-on). Where required by law, we honor recognized browser opt-out signals such as Global Privacy Control (GPC). We do not currently respond to other “Do Not Track” signals.

We do not sell your personal information for money, and we do not share mobile opt-in / SMS consent data with third parties for their marketing. We may share information as follows:
- Service providers that perform functions on our behalf (hosting, scheduling, analytics, payment processing, communications, IT and security) under contractual confidentiality and data-protection obligations.
- Healthcare and treatment partners as needed to provide care, consistent with HIPAA and our Notice of Privacy Practices.
- Advertising and analytics partners as described above, subject to the health-data limitations in Section 4.
- Legal and safety when required by law or to protect rights, property, or safety.
- Business transfers in connection with a merger, acquisition, or sale of assets.
6. Text (SMS) Messaging and Mobile Data ↑ Top
If you opt in to text messaging, we use your mobile number to send the messages you requested (such as appointment reminders, support, and — where separately agreed — promotions). You can opt out anytime by replying STOP, or get help by replying HELP.

Depending on the state where you live, you may have some or all of the following rights:
- To know the categories and specific pieces of personal information we collect, use, and disclose.
- To access a copy of your information in a portable format.
- To correct inaccurate information.
- To delete your information, subject to legal exceptions (including healthcare recordkeeping requirements).
- To opt out of “sales” or “sharing” of personal information and of targeted advertising.
- To limit the use of sensitive information, including health-related information.
- To not be discriminated against for exercising these rights, and where applicable, to appeal a denial.

California residents
California residents have rights under the CCPA (as amended by the CPRA) and additional protections for medical information under the Confidentiality of Medical Information Act (CMIA). California’s “Shine the Light” law permits residents to request information about disclosures for third-party direct marketing; we do not share personal information with third parties for their own direct marketing.
Nevada residents
Nevada residents may direct us not to sell certain covered information as defined under Nevada law (NRS 603A). We do not sell such information; to submit a verified opt-out request, contact us using the details below.
Other states
Residents of other states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Texas, Utah, and others) may have similar rights. We honor applicable rights based on your state of residence.
8. Health Information and HIPAA ↑ Top
As a licensed healthcare provider, Body Balance Medical is a HIPAA-covered entity. Our use and disclosure of Protected Health Information for treatment, payment, and healthcare operations — and your rights regarding that information — are described in our Notice of Privacy Practices. To the extent any information is governed by HIPAA, the Notice of Privacy Practices controls.
9. Children’s Privacy ↑ Top
The Services are not directed to children under 16, and we do not knowingly collect personal information from anyone under 16. If we learn that we have collected such information, we will delete it. Minors are treated only in person under the involvement and consent of a parent or legal guardian as required by law.
10. How We Protect Your Information ↑ Top
We maintain administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we are required to provide breach notification under applicable law, we will do so.

We retain information only as long as necessary for the purposes described in this Policy or as required by law. Healthcare and financial records are retained for the periods required by applicable recordkeeping and other legal obligations.
