By accessing or using the Services, creating an account, submitting an inquiry or form, opting in to text messaging, or otherwise interacting with us through the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Services.
These Terms apply to the Website and online Services only. The professional medical and aesthetic services provided to you in person are governed by the separate consent forms, treatment agreements, and clinical documentation you receive at the clinic.
2. Eligibility ↑ Top
The Services are intended for users who are 18 years of age or older and located in the United States. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and current.
3. No Medical Advice; No Provider–Patient Relationship Through the Website ↑ Top
The content on the Website is for general informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment. Reading the Website, submitting a form, or communicating with us online does not create a provider–patient relationship. That relationship is established only after you complete an in-person evaluation with a licensed Body Balance Medical clinician and are formally accepted for care.
Never disregard or delay seeking professional medical advice because of something you read on the Website. Always consult a qualified healthcare provider with questions about a medical condition, medication, or treatment.
4. Our Services; Assessments and Candidacy ↑ Top
Body Balance Medical is a licensed medical aesthetics and wellness clinic in Las Vegas, Nevada, offering services that may include Hormone Optimization (including testosterone replacement therapy and Biote Hormone Pellet Therapy), medical weight loss using Compounded Semaglutide and Compounded Tirzepatide, medical aesthetics, IV therapy, peptide and vitamin injections, body composition analysis, and red light therapy.
All medical and prescription services are provided only after a clinical evaluation conducted by a licensed clinician. Candidacy is determined on an individualized basis. Submitting a request or scheduling a visit does not guarantee that any particular treatment will be recommended, prescribed, or provided. Our clinicians retain sole professional discretion to decline, modify, or discontinue any treatment based on their clinical judgment.
5. Compounded and Prescription Therapies ↑ Top
Certain therapies involve compounded medications (including Compounded Semaglutide, Compounded Tirzepatide, and compounded peptides such as sermorelin). Compounded medications are prepared by a licensed compounding pharmacy and are not reviewed or approved by the U.S. Food and Drug Administration (FDA) for safety, effectiveness, or manufacturing quality. They are prescribed only when a licensed clinician determines they are appropriate for an individual patient.
Compounded weight-management medications (GLP-1 therapies). Our medical weight-loss program may use compounded semaglutide or compounded tirzepatide. These compounded preparations are not the same as, and are not therapeutically equivalent to, any FDA-approved brand-name product, and the FDA has not evaluated them for safety or effectiveness. They are provided only pursuant to a prescription from a licensed clinician who has determined, following an individualized evaluation, that the therapy is appropriate for you, and they require ongoing follow-up. As with any medication, these therapies carry potential risks and side effects, which your clinician will review with you. Individual results vary and are not guaranteed.
Nothing on the Website should be interpreted as an offer to sell, or a solicitation to purchase, any prescription medication without an appropriate clinical evaluation and prescription.
6. Appointments, Cancellations, No-Shows, and Deposits ↑ Top
You may cancel or reschedule an appointment without charge up to 24 hours before the scheduled start time. Appointments cancelled less than 24 hours in advance, or missed without notice (“no-shows”), are subject to a $25 late-cancellation or no-show fee charged to the payment method on file.
Online, appointments may be booked up to one (1) hour before the start time and up to six (6) months in advance. Certain services may require a deposit to reserve your time; if so, the deposit amount and terms will be disclosed at the time of booking. Cancellation, no-show, and deposit terms are presented when you book and may be updated from time to time.
7. Memberships and Recurring Billing ↑ Top
If you enroll in a membership program (for example, an Aesthetics membership, an IV Therapy membership, or the Body Balance Pellet & Wellness hormone optimization membership), the following terms apply in addition to the specific membership agreement you accept at checkout, which controls in the event of any conflict with these Terms:
- Recurring billing. Membership fees are charged automatically to the payment method on file each month on the date of your original purchase (your membership start date). A valid payment method must remain on file for the duration of the membership.
- Minimum commitment. Memberships have a minimum commitment period that varies by plan (typically one (1) to six (6) months). Early cancellation before the commitment period is completed is not permitted.
- Cancellation. After the commitment period, you may cancel by giving the advance written notice required by your membership agreement (typically 14 to 30 days) before your next billing date, using the cancellation method that agreement specifies — through the client portal where offered, or by contacting us at contactus@bodybalancemedical.com. If notice is received fewer days before the billing date than required, one additional charge may occur before cancellation takes effect. Membership discounts and benefits end when the cancellation takes effect.
- Prescription medication memberships. For memberships that include prescription medications (such as our Compounded Semaglutide, Compounded Tirzepatide, or testosterone programs), medication is dispensed only when a licensed clinician determines it is appropriate and requires ongoing follow-up visits. Once a given month’s medication has been ordered, prepared, dispensed, or shipped, that month’s charge is non-refundable, and missed or unused doses do not roll over.
- Treatment credits (where applicable). Some memberships provide monthly treatment or “wallet” credits applied toward eligible services. Unless your membership agreement states otherwise, such credits cannot be redeemed for cash, cannot be transferred, are non-refundable, accumulate while the membership remains active, and any unused credits remain available after cancellation.
- Failed payments. If a scheduled payment fails or is declined, membership benefits will be suspended until payment is successfully processed.
- Medical appropriateness. All membership services are subject to provider evaluation and medical appropriateness. Body Balance Medical may modify or decline treatment when medically necessary.
8. Pricing, Payment, and Financing ↑ Top
Prices are subject to change without notice and may vary based on your individualized treatment plan. Quoted prices are estimates until confirmed at the time of service. You are responsible for all charges associated with services you receive and any payment method you authorize.
We offer third-party financing through Cherry and CareCredit, provided by those third parties under their own terms and approval criteria. Body Balance Medical does not control and is not responsible for their decisions, rates, or servicing.
9. Refunds ↑ Top
Membership fees, services rendered, and membership credits are non-refundable. Because medical and aesthetic services are personalized and performed by licensed professionals, payments for completed services are not refundable. Specific terms for products, packages, memberships, and prepaid services are provided at the time of purchase and govern that transaction.
10. Promotions ↑ Top
Promotions and special offers are subject to the specific terms disclosed at the time of the offer, may be time-limited, cannot be combined unless stated, have no cash value, and may be modified or discontinued at any time.
11. Results and Testimonials Disclaimer ↑ Top
Individual results vary and are not guaranteed. Any outcomes, timeframes, testimonials, reviews, or before-and-after content reflect individual experiences and are not a promise or prediction of the results you will achieve. Results depend on many factors, including your physiology, medical history, adherence to your plan, and lifestyle.
12. Text (SMS) Messaging Program ↑ Top
By providing your mobile number and opting in, you consent to receive text messages from Body Balance Medical, which may include appointment reminders, service updates, account notifications, customer support, and — where you separately agree — promotional messages. Message frequency varies.
- Consent is not a condition of purchase. You are not required to agree to promotional texts to receive services.
- Opt out: reply STOP to any message, or text STOP to (702) 843-0590. You will receive one confirmation and then no further texts.

- Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Mobile opt-in data is never shared with third parties or affiliates for their marketing or promotional purposes.

The Website and its content — including text, graphics, logos, the Body Balance Medical name and marks, images, and design — are owned by Body Balance Medical or its licensors and protected by intellectual property laws. You may view and use the Website for personal, non-commercial use only. Third-party marks (such as Biote, Boulevard, Cherry, and CareCredit) are the property of their respective owners.

You agree not to use the Services to violate any law; submit false or fraudulent information; infringe the rights of others; transmit harmful code; attempt unauthorized access to our systems; harvest information about other users; or interfere with the operation, security, or integrity of the Services.
15. User Content, Reviews, and Submissions ↑ Top
If you submit reviews, comments, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business, including marketing, unless prohibited by law. You represent that you have the right to submit it. We may moderate or remove content at our discretion. Do not submit protected health information through public comment areas.

The Website may link to or integrate third-party platforms (for example, our scheduling platform Boulevard, financing partners, and social media). We do not control and are not responsible for third-party content, products, services, or privacy practices.

Your use of the Services is also governed by our Privacy Policy. Protected health information that we handle as a HIPAA-covered entity is governed by our separate Notice of Privacy Practices.

THE WEBSITE AND ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. We do not warrant that the Website will be uninterrupted, error-free, or secure. This disclaimer applies to the Website and online Services; it does not limit any rights you have in connection with the professional medical care you receive in person.

TO THE FULLEST EXTENT PERMITTED BY LAW, BODY BALANCE MEDICAL AND ITS OWNERS, CLINICIANS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR ONLINE SERVICES. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, PERSONAL INJURY CAUSED BY PROFESSIONAL NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to indemnify and hold harmless Body Balance Medical and its owners, clinicians, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
21. Dispute Resolution; Governing Law; Venue ↑ Top
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Except where prohibited, any dispute relating to the Website or online Services will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

We may update these Terms from time to time. The “Last Updated” date reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Services after changes take effect constitutes acceptance.
23. General ↑ Top
- Severability. If any provision is unenforceable, the remaining provisions remain in full effect.
- Entire Agreement. These Terms, the Privacy Policy, and any service-specific agreements are the entire agreement regarding the online Services.
- Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
