By accessing our website, booking an appointment, receiving services, or opting in to our SMS program, you agree to be bound by these Terms. If you do not agree, please do not use our services or website.

These Terms should be read alongside our Privacy Policy, which is incorporated herein by reference.

Acceptance of Terms

By accessing or using any part of our website at bodybalancemedical.com, booking any service, receiving treatment, or opting in to any communications from Body Balance Medical, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them.

If you are accessing our Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Services & Medical Disclaimer

Body Balance Medical provides medical aesthetics, wellness, and related clinical services including but not limited to neurotoxin injections, dermal fillers, microneedling, weight loss solutions, hormone optimization, testosterone replacement therapy (TRT), IV therapy, peptide therapy, red light therapy, and related services ("Services").

No Guarantee of Results

Results from any treatment or service vary between individuals. Body Balance Medical makes no guarantees, warranties, or representations regarding specific outcomes. Any before-and-after photos, testimonials, or case studies presented on our website are illustrative examples only and are not a guarantee that you will achieve the same or similar results.

Treatment Eligibility

All services are subject to a clinical assessment. Body Balance Medical reserves the right to decline to perform any service if, in the professional judgment of our clinical staff, the service is not appropriate or safe for a given individual. It is your responsibility to disclose all relevant medical history, medications, allergies, and conditions prior to receiving any treatment.

Informed Consent

Prior to receiving any treatment, you will be asked to review and sign an informed consent document. That consent document, along with any intake forms, is incorporated into and forms part of your agreement with Body Balance Medical.

Age Restriction

Our Services are available to individuals who are 18 years of age or older. We do not provide services to minors without documented parental or guardian consent, and some services are not available to minors at all regardless of consent.

Appointments & Cancellations

Booking

Appointments may be booked through our website, by phone, or through our authorized booking platforms. Booking an appointment constitutes your agreement to arrive at the scheduled time and to receive the agreed-upon service, subject to clinical suitability.

Cancellation & Rescheduling

We ask that you provide at least 24 hours' notice if you need to cancel or reschedule an appointment. Late cancellations or no-shows may be subject to a cancellation fee. Repeated no-shows may result in a requirement to prepay for future appointments or in the termination of your ability to book with us.

Late Arrivals

If you arrive significantly late for your appointment, we may need to shorten your treatment time or reschedule your appointment entirely to avoid impacting other clients. Full charges may still apply at our discretion.

Right to Refuse Service

Body Balance Medical reserves the right to refuse service to any individual at any time, for any lawful reason, including but not limited to concerns about patient safety, disruptive behavior, or clinical contraindications.

Payments, Fees & Refunds

Pricing

All prices for services are as quoted at the time of booking or as displayed on our website or in-office menus. Prices are subject to change without notice. Promotional pricing is valid only for the period specified and cannot be combined with other offers unless explicitly stated.

Payment

Payment is due at the time of service unless alternative arrangements have been made in advance. We accept major credit cards, debit cards, and financing through approved third-party partners (such as Cherry and CareCredit). By providing payment information, you authorize us to charge the applicable amount for your service(s).

Financing & Payment Plans

Financing options are offered through third-party providers. Approval, terms, and conditions for financing are determined solely by those providers and are separate from your agreement with Body Balance Medical. We are not responsible for the terms, rates, or decisions of any third-party financing partner.

Gift Cards

Gift cards are non-refundable and have no cash value. They may not be exchanged for cash and are valid only for services at Body Balance Medical. Lost or stolen gift cards cannot be replaced.

Refund Policy

Due to the nature of medical services, all sales are generally final. We do not offer refunds for services rendered. If you have a concern about a service you received, please contact us within 72 hours of your appointment so that we can address your concern. Refunds, credits, or complimentary follow-up treatments are granted at our sole discretion on a case-by-case basis.

Prepaid service packages and memberships are non-refundable once initiated. Unused portions of prepaid packages may be transferred to another individual at our discretion.

Chargebacks

If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to dispute the chargeback and to discontinue your access to our Services. We will provide documentation to the relevant payment processor in support of our position.

SMS Messaging Terms

These terms govern your participation in the SMS messaging service provided by Body Balance Medical. By opting in, you agree to receive SMS messages in accordance with these terms.

Consent to Receive SMS Messages

By providing your mobile number and opting in, you consent to receive SMS messages from Body Balance Medical. These messages may include appointment reminders, service updates, promotional offers, and other related notifications. Consent to receive SMS messages is not a condition of purchasing any service.

Data Sharing

Customer data is not shared with third parties for promotional or marketing purposes. Mobile opt-in and consent data are never shared with anyone for any purpose. Any information sharing mentioned elsewhere in our Privacy Policy excludes mobile opt-in data.

Message Frequency

You may receive messages daily, weekly, or monthly. The exact frequency of messages will depend on your interactions with our services and the specific type of messages you receive (e.g., appointment reminders versus service updates or promotions).

Participation in any affiliate or referral program offered by Body Balance Medical is subject to the specific terms of that program, which are published separately.

Disclaimer of Warranties & Limitation of Liability

Dispute Resolution

Informal Resolution

Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or to your use of our services shall be resolved by binding arbitration in Clark County, Nevada, under the rules of the American Arbitration Association (AAA) then in effect. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, collective, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending resolution by arbitration.

Governing Law & Jurisdiction

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

Subject to the arbitration provision above, you consent to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada for the resolution of any disputes that are not subject to arbitration.
